Terms of Service

These Terms of Service (“Terms”) govern your use of FYR Innovations’ website, forms, and services (collectively, the “Services”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Who We Are

FYR Innovations provides consulting and implementation of data automation workflows and related systems for small businesses and real estate investors.

2. Use of the Services

  • You must be at least 18 years old and able to enter into a binding contract.
  • You agree to provide accurate information and to keep your contact details up to date.
  • You will not misuse, interfere with, or attempt to access the Services in an unauthorized manner.

3. Engagements, Fees & Billing

  • Project scope, deliverables, and fees are defined in a written proposal, SOW, or order form.
  • One-time setup fees and monthly retainers (if any) are due as specified in the agreement.
  • Late payments may incur a service interruption and/or late fees as permitted by law.

4. Scheduling, Cancellations & Rescheduling

  • You may reschedule booked calls using the link provided in your confirmation email.
  • Please provide at least 24 hours’ notice to cancel or reschedule where possible.
  • Missed appointments may be deemed completed at our discretion.

5. No Guarantee of Results

We design and implement systems intended to improve operations; however, specific results (e.g., deal volume, revenue, or savings) are not guaranteed. Outcomes depend on factors outside our control, including your data quality, processes, and team execution.

6. Intellectual Property

  • Pre-existing tools, frameworks, templates, and code created by FYR Innovations remain our IP.
  • Deliverables created specifically for you under a paid engagement are licensed for your internal business use.
  • You will not resell, sublicense, or publicly distribute our materials without written permission.

7. Confidentiality

Each party may receive confidential information from the other. Both parties agree to use such information only for the engagement and to protect it with reasonable safeguards. This obligation survives termination.

8. Data & Privacy

  • We process business contact data to deliver Services. See our Privacy Policy.
  • You represent that you have the right to share any data you provide to us.
  • Where we use third-party platforms (e.g., CRM, cloud, messaging), their terms and privacy policies apply.

9. Acceptable Use

  • No illegal, infringing, deceptive, or abusive activity.
  • No spam, unsolicited marketing without proper consent, or violation of carrier/anti-spam rules.
  • No introduction of malware or attempts to disrupt the Services.

10. Third-Party Services

The Services may integrate with third-party tools (e.g., GoHighLevel, n8n, Google Cloud). We do not control third-party platforms and are not responsible for their availability, performance, or security. Your use of them is subject to their separate terms.

11. Disclaimer

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FYR INNOVATIONS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY. OUR TOTAL LIABILITY FOR ANY CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNTS YOU PAID TO US FOR THE SERVICES GIVING RISE TO THE CLAIM IN THE 3 MONTHS PRECEDING THE EVENT.

13. Indemnification

You agree to indemnify and hold FYR Innovations harmless from claims arising out of (a) your misuse of the Services, (b) your violation of these Terms, or (c) content or data you provide.

14. Termination

We may suspend or terminate access to the Services if you violate these Terms or for non-payment. Either party may terminate a project according to the applicable SOW or order form.

15. Governing Law

These Terms are governed by the laws of the state in which FYR Innovations is organized, without regard to conflict of law principles. Venue for disputes will be the competent courts in that state.

16. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date will reflect the latest version. Continued use of the Services after changes constitutes acceptance.
